PURPOSE:
Does city council support authorizing the city manager to execute an amendment to the lease with South Metro Fire Rescue Fire Protection District for Station 11?

SUMMARY:
The city entered into a Pre-Unification Agreement with South Metro Fire Rescue Fire Protection District (South Metro) on April 18, 2018. On January 1, 2019, South Metro and the City of Littleton entered into a lease agreement for Fire Station 11. This lease did not include a legal description of the leased premises. The city was to seek a subdivision of the Littleton Center Subdivision and the parties were to amend the lease to describe the lease's premises as a subdivided lot that would comprise Fire Station 11.
The city determined that a subdivision of the Littleton Center Subdivision would cause unanticipated problems and expenses for the city. It was determined that a metes and bounds description of the Fire Station 11 property would be more appropriate. The amendment to the lease updates the description of the leased premises and addresses parking of vehicles near the leased premises.
PRIOR ACTIONS OR DISCUSSIONS:
The Pre-Unification Agreement with South Metro was approved April 18, 2018. The Lease Agreement was approved on January 1, 2019.

Staff Analysis
The interim city attorney reviewed the current lease, engaged in communications with legal counsel for South Metro, and after public works obtained the metes and bounds description of the property, prepared this lease amendment with the director of public works and South Metro's legal counsel's input.
