REQUESTED COUNCIL ACTION:
Does city council support amending the Littleton City Code pertaining to alcohol beverages?

BACKGROUND:
The last substantive changes to this code section were made in 1985, with minor changes occurring as recently as 2012. Since that time, several changes have occurred to the Colorado Liquor Code and Liquor Rules, including the addition of new license types, restrictions on existing license types, and passage of senate and house bills which have a direct effect on the licensing and administration of liquor licenses at the local level.

Effective October 1, 2018, all state liquor statutes were re-codified under Title 44, Articles 03 (beer code), 04 (liquor code), and 05 (special event code). All respective references to former Title 12, Articles 46, 47, and 48, have been amended to reflect the current statutes.

PRIOR ACTIONS OR DISCUSSIONS:
On July 12, 2017, the Littleton Licensing Authority met in study session to review the existing code and recommend amendments to bring the code in-line with state statute and to eliminate obsolete and redundant areas. On November 18, 2017, the Littleton Licensing Authority approved a resolution to update Title 3, Chapter 2 of the city code.

This ordinance was approved on first reading at city council's regular meeting on January 15, 2019.

STAFF ANALYSIS:
Many changes to state liquor code and state liquor rules have occurred in the years following any meaningful updates to Littleton's existing code. This proposed ordinance is an effort to mitigate redundancies and create a clearer understanding of the laws pertaining to the sale, service, and consumption of alcohol beverages.
