REQUESTED COUNCIL ACTION:
Does city council support an Intergovernmental Agreement (IGA) with Arapahoe County to provide community service case management for the Littleton Municipal Court?

BACKGROUND:
Community service can be ordered by the municipal judge as part of a defendant's sentence. Typically, it is ordered for juvenile defendants but occasionally it is ordered for adults. The defendant is sentenced to community service hours to be completed through Arapahoe County Judicial Service (ACJS). ACJS does all monitoring and reporting of the community service hours and sends reports to the court with updates, final reports of completion, and any non-compliant reports.

ACJS offers this service at no cost to the city. The costs associated with this program are paid by defendants to ACJS. The IGA establishes an intake fee of $75 for 1 to 16 hours of court-ordered community service; or $120 for 17 or more hours of community service. The fee for juveniles is $75 regardless of the number of hours ordered. This intake fee includes a $6 ACJS insurance premium.

PRIOR ACTIONS OR DISCUSSIONS:
This is a yearly renewal with Arapahoe County.

STAFF ANALYSIS:
This program is beneficial to the Littleton Municipal Court as a means of monitoring community service. In 2018, the city referred 146 defendants to the county for community service. This is the seventh year of this agreement; previously the city paid $56,000 per year to a private company to manage community service.

OPTIONS/ALTERNATIVES:
Since there is no cost to the city through this IGA, there really is not another alternative that would accomplish the same goal without significantly increasing the cost to the city.
