REQUESTED COMMISSION ACTION: The applicant is requesting approval of a Planned Development Overlay (PDO) to reduce required setbacks, increase maximum building height, reduce required parking, and reduce the open space requirements of the R-5 zone district in order to construct a five unit townhome style multifamily building.

BACKGROUND:
The applicant purchased the property with the intention of constructing a new multi-family structure for sale. The current zoning is R-5, which allows multi-family development. The applicant is seeking the variations from the R-5 regulations pursuant to Section 10-9-5 of Littleton's zoning code.

Note: Ordinance 20-2018 revised the PDO chapter of Littleton's zoning code after this application was received. Any new applications after the approval of Ordinance 20-2018 would have to comply with the updated regulations, which no longer allow residential PDOs. This application is therefore processed under the PDO regulations in place prior to Ordinance 20-2018.

PRIOR ACTIONS OR DISCUSSIONS:
The applicant submitted the PDO application in accordance with the City Code and Operating standards in December 2017 and has revised the application several times based on staff comments and concerns. After the final submittal, the applicant elected to move forward to the public hearing against staff's recommendation.

STAFF ANALYSIS:
Staff reviewed the application and PDO document in accordance with Section 10-9-5 of the Littleton City Code and finds that the requested variations cannot be accomplished without impairing the intent of the land use code.
