Subject:

Title

Motion to reappoint Christopher Cross as associate municipal court judge for a two-year term

Body

Presented By:

Steve Kemp, City Attorney

POLICY QUESTION:

Does city council support reappointing Christopher Cross as an associate municipal court judge for a two-year term beginning May 1, 2018 and ending April 30, 2020?

BACKGROUND:

Judge Feldman was appointed as the presiding municipal court judge on January 25,  2013.  From the time of statehood to the present, Colorado has recognized the importance of an independent judiciary.  Part of that independence is for the presiding judge of a court to recommend to the governing body the appointment of subordinate judges.

Pursuant to Section 58 of the Littleton City Charter, city council may consent to the recommendation of the presiding judge to appoint additional judges.   The council, in exercising this discretion, acts to ensure the appointees meet the requirements of the position.  Judge Cross has served as an associate municipal judge since May 1, 2016 and  Judge Feldman is requesting his reappointment for a two year term beginning May 1, 2018 and ending April 30, 2020.

FISCAL IMPACTS:

No additional fiscal impact is anticipated.

STAFF RECOMMENDATION:

Judge Feldman recommends appointing Christopher Cross as an associate municipal court judge for a two-year term.

PROPOSED MOTION:

Proposed Motion

I move to appoint Christopher Cross as an associate municipal court judge for a two-year term, effective May 1, 2018.  The city attorney is directed to prepare, and the mayor is authorized to execute, a two-year contract with Judge Cross.
