POLICY QUESTION:
Does city council support a resolution to vacate a 10-foot utility easement within the Platte 56 subdivision?

BACKGROUND:
The Platte 56 development is an approximately 3 acre site that is located near the intersection of West Belleview Avenue and South Prince Street, north of the Walgreens Pharmacy, west of the South Platte River, and south of the Riverside Apartments.



The existing site was encumbered with a 24-inch public sanitary sewer main, and associated easements running north-south through the site. The alignment of the sanitary sewer did not align with the lot configuration proposed by the Platte 56 development. In order to develop the site as proposed, the Platte 56 developer, Central Development, L.L.C. designed the sanitary sewer main to be relocated within their subdivision to eliminate conflicts with the new proposed lots and structures.

PRIOR ACTIONS OR DISCUSSIONS:
The Platte 56 Final Plat of Subdivision was approved by the City Council on July 18, 2017 via Resolution 27-2017.

STAFF ANALYSIS:
The final plat of subdivision anticipated the subject easements to be vacated, as shown on Page 4 of the approved plat (excerpt below). The easements could not be vacated at the time of final plat approval since the sanitary sewer main had not yet been relocated. A new 26-foot sanitary easement was granted for the new sanitary sewer main as part of the approved final plat. The developer has also obtained approval from Denver Water for vacation of their respective easements, which do not require approval from the city.
