POLICY QUESTION:

Does city council support amending Chapter 4 of Title 6 to remove  references to and definitions of gravity knives and switchblade knives in alignment with state statute?

 

BACKGROUND:

In March, Governor Hickenlooper signed Senate Bill 17-008, which became effective in early August. The bill removes the definitions of "gravity knife" and "switchblade knife" from C.R.S. §18-12-101 and the reference to both types of knives from C.R.S. §18-12-102 (Possessing a dangerous or illegal weapon).

 

STAFF ANALYSIS:

In order to bring the city code into compliance with state statute, the City Attorney’s Office prepared an ordinance to update the code, specifically sections §§6-4-151 and 6-4-154, to reflect these changes.

 

OPTIONS/ALTERNATIVES:

Failure to update the city code will result in nonconformance with state statute.

 

FISCAL IMPACTS:

None.

 

STAFF RECOMMENDATION:

Staff recommends approving the ordinance.
