POLICY QUESTION:
Does city council support approving a Title VI Plan for the Omnibus program?

BACKGROUND:
Title VI of the Civil Rights Act of 1964 protects people from discrimination based on race, color, and national origin in programs and activities receiving federal financial assistance. The Federal Transit Administration (FTA) provides financial assistance to develop new transit systems and improve, maintain, and operate existing systems. The FTA works to ensure nondiscriminatory transportation to enhance the social and economic quality of life for all Americans.

As a requirement of receiving any funds from the Colorado Department of Transportation (CDOT), the City of Littleton must have a Title VI Plan on file with the Division of Transit and Rail and this plan must be approved by CDOT's Civil Rights and Business Resource Center.

Title VI prohibits discrimination by recipients of federal financial assistance on the basis of race, color, and national origin, including the denial of meaningful access for limited English proficient persons. It prohibits, among other things, using "criteria or methods of administering its program which have the effect of subjecting individuals to discrimination based on their race, color, or national origin." In addition, Title VI and CDOT regulations prohibit recipients from intentionally discriminating against people on the basis of race, color, and national origin.

STAFF ANALYSIS:
The city applied for a grant from the FTA through CDOT's Division of Transit and Rail, to purchase two new Omnibuses. The city was awarded one of the 2015, 5310 Large Urban Awards. Approval of the grant agreement will replace two buses in the fleet - a 2006 and a 2008 14-passenger bus.
