POLICY QUESTION:
Does city council support amending the charter regarding railroad tracks, crossings and switches?

BACKGROUND:
Council passed Resolution 28-2013 creating the 2013 Littleton Charter Review Committee (LCRC) and directed the committee to review the charter and to make recommendations to the council for potential amendments to address the current and future needs of the city. The LCRC met between 9/9/13 and 5/28/14 to review and discuss the charter, and on 8/5/14 made amendment recommendations to council. On 5/26/2015, council requested staff to bring forward the ordinances for the proposed charter amendment ballot questions.

STAFF ANALYSIS:
Section 116 of the charter provides that the city council may require any railroad or any other transportation system to pay a fair apportionment of the total cost to raise or lower any of its property or tracks running over, under or along or across any public street or to construct or maintain street crossings, bridges, etc. This section is no longer relevant to the operations of the city and the subject area is regulated by the Colorado Public Utilities Commission.

Section 117 of the charter provides that the city council may issue revocable licenses to lay side tracks and switches alongside rail tracks. This section is no longer relevant to the operations of the city as we have no "at-grade" crossings that would allow for side tracks or switches to be laid. Additionally, this subject area is regulated by the Colorado Public Utilities Commission.

Staff recommends approval of the ordinance.
