Title
Ordinance on second reading granting an easement to Xcel Energy
Body

Presented By:
Charles Blosten, Director of Public Works

POLICY QUESTION:
Does city council support granting an easement to Xcel Energy to move a street light on South Broadway?

BACKGROUND:
Xcel Energy operates gas and electric utility facilities in Littleton under a franchise agreement.  The franchise allows Xcel Energy to utilize street right of way to construct, operate, maintain, repair and replace its pipes, cables, wires, transformers and other facilities.

There is an existing street light on the west side of South Broadway, located south of the intersection with East Arapahoe Road.  The City of Littleton has been working on plans to widen the sidewalk in this area. Xcel Energy has agreed to relocate a street light in conflict with the sidewalk.  An easement is needed for the new street light location outside of the street right of way.  Xcel Energy has requested the city grant an easement in Little's Creek Park.  Xcel Energy executes real estate transactions as the Public Service Company of Colorado.

STAFF ANALYSIS:
The  easement is located in irrigated turf.  South Suburban Parks and Recreation maintains Little's Creek Park and does not object to relocation of the street light.  Any disturbed areas will be restored to a condition equal to or better than presently exists upon completion of construction. No impact to public use of the park is anticipated.

FISCAL IMPACTS:
Granting of the easement is proposed at no cost to Xcel Energy.  The street light will be relocated at no cost to the city.

STAFF RECOMMENDATION:
Staff recommends the city grant the easement.

PROPOSED MOTION:
Proposed Motion
I move to approve on second reading the ordinance granting an easement to Xcel Energy.
