PURPOSE:

Staff is seeking to inform city council of the number of existing fuel sales (retail)/gas station locations and the process to apply for development of another location.  Staff is seeking city council’s direction regarding potential updates to the Unified Land Use Code (ULUC) pertaining to this land use.

DISCUSSION:

Staff will provide a presentation focusing on the current number of gas stations, the process to develop a new gas station, and options to be considered in any potential update to the ULUC including the possibility of placing a moratorium on new gas station applications while any potential ordinance update is researched and drafted.

 

BACKGROUND:

The number of gas stations within the city has been a topic of discussion for many years.  The ULUC limited the zoning district that allowed this use to two (Industrial and Business Commercial) and allowed the use as a conditional use in two other districts (Neighborhood Commercial and Corridor Mixed).  Since the ULUC, there have been several gas station development applications and one location that recently opened.  These projects spurred discussion around the ULUC being too permissive allowing for this use.  Additionally, several regional municipalities have implemented moratoriums on new gas station development, which may result in proposals in cities that still allow the use.

Staff is seeking clarifying questions and feedback on proposed policy topics and interest in potential next steps.
