BACKGROUND:

Per Section 8 of the Littleton City Charter, "Amendments to this Charter may be framed and submitted to the registered electors through petitioning the Council, or framed and submitted to the registered electors by Council on its own initiative, in accordance with the provisions of Article XX of the Constitution of the State of Colorado." Section 9 to Article XX of the Constitution directed the General Assembly to adopt legislation to implement that provision of the state Constitution, which the General Assembly did with the adoption of the Municipal Home Rule Act of 1971, C.R.S. ?? 31-2-201, et seq., (the "Act"). The Act contains the specific procedural requirements for amending home rule charters and governs this proposed amendment of the city's charter that has been initiated by petition.

The Act specifies that the citizen initiative process is commenced when a statement of intent to circulate a petition is filed with the city clerk. The petition is then submitted to the city clerk for approval as to form. C.R.S. ? 31-2-221 (1). The citizens circulate the petition and file the results with the city clerk at least 90 days before the election. C.R.S.? 31-2-210(1)(a)(IV). Once the petition is declared sufficient, the city clerk then certifies the validity of the petition to the city council, and at the next regular meeting, the city council sets the ballot title. C.R.S. ? 31-2-210(3).
