PURPOSE:
The purpose of this item is to discuss a future text amendment to the Unified Land Use Code (ULUC) regarding electric vehicle (EV) charging stations.

DISCUSSION:
Staff will provide an overview of the future EV charging station text amendment to the ULUC to the planning commission. Staff has been drafting a potential update to the sections of the ULUC that pertain to EV charging stations in conjunction with a consultant from the State of Colorado. Staff intends to highlight the items that are required by recent Colorado legislation and discuss the areas that remain at the discretion of a municipality.


BACKGROUND:
Colorado House Bill 24-1173 mandated the creation of a model land use code for electric vehicle charging. That legislation resulted in the creation of the "Colorado Electric Vehicle Charging Model Land Use Code & Guidance" document. This document was completed in March of 2025 by the Colorado Energy Office. The 2024 legislation indicated an implementation date of January 1, 2026. An extension has been provided to that timeline to allow additional time for municipalities to comply with the model code. Over the past six months staff has been in communication with the State and their consultant regarding draft ULUC text amendment language.

The following is a synopsis of the proposed changes that will be discussed in the attached presentation:
