POLICY QUESTION:
Does city council support releasing the city's interest in a permanent roadway purposes and utility easement to facilitate development of the Erickson Subdivision?
BACKGROUND:
In about 1996, a roadway purposes and utility easement was dedicated by document to the City of Littleton to construct the West County Line Road grade separation under the railroad tracks.
Erickson Subdivision, located east of the South Santa Fe Drive and south of West County Line Road, was platted in 2005. Lot 1, Block 1 located on the west end of the subdivision, was recently re-platted as Littleton Commons West. In 2013, city council approved release of the city's interest in a slope easement on the property, along with vacation of a portion of the West County Line Road right of way that was no longer needed for street or utility purposes. With the Littleton Commons West plat, a 30 foot drainage easement was vacated.
The property owner has requested the city release its interest in the roadway purposes and utility easement in order to develop the lot, as the easement conflicts with proposed development.
STAFF ANALYSIS:
Erickson Subdivision developers constructed West County Line Road street improvements, which eliminated the need for the subject easement for roadway or utility purposes. The easement, while titled a Permanent Roadway Purposes and Utility Easement, was also utilized for facilities in West County Line Road to collect drainage from a pond and the land located south and east of the subject property, and convey to a storm sewer.
