PURPOSE:
Council consideration of a resolution opposing House Bill 25-1060: Electronic Fence Detection Systems.

DISCUSSION:
House Bill 25-1060 Electric Fence Detection Systems seeks to reclassify electric fences under alarm systems which could limit the city’s ability to deny permits.
HB 25-1060 defines an electronic fence detection system which is a security system that is used in conjunction with a fence. An electronic fence detection system includes a detector that, when contacted caused an alarm system to transmit a signal to the property owner. If passed this would allow for electronic fences of up to 10 feet in height to be placed behind the typical 6-foot fence only for those locations that are not exclusively residential.
The bill presents a number of concerns related to once again the state dictating to a home-rule municipality what we as a city should accept and approve and where. It also raises concerns about safety as well as aesthetic concerns.
CML is recommending a no vote on HB 25-1060.
Prior Actions or Discussions
At the March 18, 2025, regular meeting of council, the city attorney presented an overview of current legislation which would have an impact on municipalities, including Littleton. Council directed staff to prepare a resolution opposing HB 25-1060.
