POLICY QUESTION:

Does city council support an Intergovernmental Agreement with Arapahoe County to provide community service case management for the Littleton Municipal Court?

BACKGROUND:

Community service can be ordered by the municipal judge as part of a sentence. Typically, it is ordered for juvenile defendants, but occasionally it is ordered for adults. The person is sentenced to a specific number of community service hours, to be completed through Arapahoe County Judicial Services (ACJS). ACJS does all monitoring and reporting of the community service and sends reports to the court with updates, final reports of completion, and any non-compliant reports.

ACJS offers this service at no direct cost to the city. The costs associated with the program are paid by defendants to ACJS. Paragraph 7 of the IGA establishes an intake fee of $50 dollars for one to 16 hours of court ordered community service; or $100 for 17 or more hours of community service. The fee for juveniles is $50 regardless of the number of hours ordered. This intake fee includes a $5 CIRSA insurance premium. There may be some minimal costs associated with referrals of indigent defendants. These referral fees would have to be paid by the city. However, as a general policy the court will allow indigent defendants to do community service on their own, at a non-profit organization, and pay the city a $5 CIRSA insurance fee.

STAFF ANALYSIS:

This program is beneficial to the Littleton Municipal Court as a means of monitoring community service and saving the City of Littleton funds by making the offenders responsible for fees associated with community service.
