POLICY QUESTION:
Does city council support granting an easement to Arapahoe County for an existing stairwell and wall at Bradley House?

BACKGROUND:
The City of Littleton owns the Bradley House property at 5844 S. Datura St. The building was constructed about 1975. South Metro Housing Options operates the Bradley House for senior apartments.

Arapahoe County owns the adjacent properties addressed as 5804 and 5814 S. Datura St which are currently used as part of the Colorado State University Extension Program. Arapahoe County plans to sell the property. A survey has shown a portion of a stairwell and wall to the building addressed as 5814 S. Datura St. is encroaching upon the Bradley House property. The county building was built about 1974. Until the most recent survey was done, it was unknown a small portion of Arapahoe County's building was on Littleton property. The encroachment is an encumbrance to the sale of the property.

Arapahoe County has requested the city grant an easement for the stairwell and wall encroachment.

STAFF ANALYSIS:
The proposed easement is less than five feet at its widest point and totals about 72 square feet. The easement is in a paved driveway and does not interfere with vehicle or pedestrian access or parking.

Arapahoe County's survey found other areas of concern. There are encroachments of the city parking lot and South Metro Housing Options' fence on Arapahoe County's property, and county parking onto the S. Datura St. right-of-way. The right-of-way encroachment is being addressed through a revocable permit.

FISCAL IMPACTS:
Granting the easement is proposed at no cost to the county or the proposed buyer.

STAFF RECOMMENDATION:
Staff recommends granting the easement.
