PURPOSE:
The purpose of this ordinance is to amend the city’s liquor licensing provisions to be consistent with changes in state law related to the license types that may apply for tastings permits.

DISCUSSION:
Last year, changes occurred in state law that permitted additional liquor license types to apply for tastings permits. Specifically state law C.R.S. § 44-3-301(10)(b) added fermented malt beverage and wine retailer licensees would be eligible to apply for tastings permits. Those types of retailers are those establishments that sell malt and vinous liquors for off-premises consumption that derive at least 20% of their gross annual revenues from the sale of food items for consumption off premises; the types of establishments that would hold this type of license would be grocery stores or certain convenience stores.

This ordinance passed on first reading on May 21, 2024.

Staff recommends approving the ordinance to be consistent with state law.
