REQUESTED COUNCIL ACTION:
Does city council support approving the Asset Conveyance Authorization Agreement between City of Littleton, Littleton Fire Protection District and Highlands Ranch Metro District authorizing the city to convey the assets of Littleton Fire Rescue (LFR) to South Metro Fire Rescue Fire Protection District?
BACKGROUND:
In November 2017, Littleton Fire Protection District and Highlands Ranch Metropolitan District notified the city that they would be terminating their participation in LFR as of December 31, 2018. The voters of these districts approved the inclusion of their areas into the South Metro Fire Rescue Fire Protection District (SMFR). On April 18, 2018, the city entered into a pre-unification agreement with SMFR. During the time that the partners participated in LFR, the city managed a majority of the property regardless of who paid for it. The city employed the LFR staff and managed the LFR budget.
With all three partners in LFR moving to SMFR, they have agreed to enter into an Asset Conveyance Authorization Agreement to convey all property to SMFR.
PRIOR ACTIONS OR DISCUSSIONS:
City council approved the Pre-Unification Agreement with SMFR on April 18, 2018.
STAFF ANALYSIS:
The city has functioned as the managing entity of LFR since its inception. The Asset Conveyance Authorization Agreement would result in a more efficient disposition of LFR’s assets. All parties have an identical interest in assuring the seamless transfer of responsibility for fire protection and emergency services to the SMFR.
Approval of this agreement will result in the council being requested to authorize certain transactions on behalf of LFR to complete the movement of fire and emergency services to the SMFR. The proposed agreement is consistent with the purpose and language of the pre-unification agreement between the City of Littleton and SMFR.
OPTIONS/ALTERNATIVES:
Option A: Not approve the Asset Conveyance Authorization Agreement and force the respective members of e to convey property to each other prior to the property being conveyed to SMFR. This would result in additional costs to the city from multiple recordings of documents and substantial additional legal work.
Option B: Approve the asset conveyance authorization agreement and convey LFR property on behalf of all of its members to SMFR.
FISCAL IMPACTS:
No additional fiscal impacts are projected beyond those that are part of the transfer of fire protection and emergency services.
STAFF RECOMMENDATION:
Staff recommends that council approve the Asset Conveyance Authorization Agreement between the City of Littleton, Littleton Fire Protection District and Highlands Rand Metropolitan District.
