PURPOSE:

Amend the Kendig Keast Collaborative contract for the Unified Land Use Code project and fund the increase and additional contract legal review through the 2020 Policy Question 1 budget proviso.

SUMMARY:

City Council approved 2020 Policy Question 1 to address post comprehensive plan initiatives in Downtown and the Santa Fe Corridor under a 2020 budget proviso.

 

Council and Planning Commission are currently working through Phase I amendments to the city’s existing land use codes to address conflicts with the Comprehensive Plan relative to Downtown development. Council adopted two 90-day moratoriums and is on schedule to consider the Phase I amendments in May 2020.

 

Concurrently, the City is following through on the priority recommendation of the Comprehensive Plan to update its regulatory framework by launching the transition to a Unified Land Use Code (ULUC) with consultants Kendig Keast Collaborative (KKC). The ULUC will replace Title 10, Zoning Regulations; Title 11, Subdivision Regulations; portions of Title 4, Building Regulations pertaining to Mobile Homes and Mobile Home Parks and Historic Preservation; and the Downtown Design Guidelines. Adoption of the ULUC is anticipated in October of 2021.

 

Council has expressed an interest in further amending the city’s existing land use codes to address additional issues including open space requirements, building height requirements, Downtown massing/step-backs, Downtown transition zones, front set-backs, sub-division of lots, and parking relative to Downtown development. Staff directed KKC to develop an amendment to their scope so that these other more complex conflicts with the Comprehensive Plan can be addressed by the end of 2020 as a Phase II of Downtown amendments.

 

The scope amendment increases the KKC contract by $7,800 and staff is recommending an additional $23,000 for legal review. The KKC scope amendment includes drafting the contents of KKC Deliverable #1 ‐ Downtown Building Block, by redlining the City’s existing Title 10, Zoning Regulations as well as the Downtown Design Standards. This work would carry over to the Consolidated Public Review Draft of the Unified Land Use Code set for release in June of next year.

 

The two temporary moratoriums of 90 days conclude on May 14, 2020. One moratorium bans auto-oriented uses in Downtown during this time.  The other moratorium prohibits multi-family residential development.  Council may choose to discuss extending one or both of the current 90-day moratoriums. An additional 150 days would be required to review the Phase II draft amendments, release the draft amendments for public comment, and begin the public hearing process.

 

PRIOR ACTIONS OR DISCUSSIONS:

Envision Littleton was developed to be a multi-year and multi-milestone commitment to planning for the next 20 years of the city. The top priority identified in the Comprehensive Plan is to update the city’s regulatory framework and transition to a Unified Land Use Code (ULUC). The ULUC kicked off during the February 10, 2020 community event hosted at Town Hall Arts Center and the Joint Leadership Session of City Council and Planning Commission on February 11, 2020.

The transition to the ULUC is on schedule and on budget. The proposed amendment to KKC’s contract will not impact the overall schedule for Council to consider adoption of the ULUC in October 2021.

Fiscal Impacts

The 2020 budget includes $300,000 for Policy Question 1 to address post comprehensive plan initiatives in Downtown and the Santa Fe Corridor under a budget proviso. This request totals $30,800 and includes both the scope and budget amendment to KKC’s contract in the amount of $7,800 and $23,000 for contract legal review.

 

Alternatives

Proceed with the current contract for KKC, eliminate phase II amendments, and consider adoption of the Unified Land Use Code which includes the Downtown building block in October 2021.

 

STAFF RECOMMENDATION:

Staff recommends amending KKC’s contract to draft the contents of Deliverable #1 ‐ Downtown Building Block, by redlining the City’s existing Title 10, Zoning Regulations and releasing a portion of the budget proviso for 2020 Policy Question 1. The draft amendments will be released as Phase II Downtown Amendments in July 2020 and considered by Council on October 6, 2020 following a public review, study session, and first reading of the ordinance. The contents of Deliverable #1 from the existing Title 10 will then be incorporated into the Consolidated Public Review Draft of the Unified Land Use Code set for release for public review in June 2021.
