PURPOSE:

Approving a Revocable License Agreement between the City of Littleton and the Town of Columbine Valley for installation of a License Plate Reader Camera at the intersection of South Watson Lane and West Bowles Avenue.

DISCUSSION:

The City of Littleton owns public right-of-way throughout the city. These public rights-of-way are generally dedicated to the city with the property subdivision plats.

 

The Town of Columbine Valley utilizes license plate reader cameras throughout their community. These cameras are typically attached to existing light poles, or a new pole is installed at the desired location. The cameras read license plates of the vehicles passing by and report the plate numbers to the owner of the camera. The City of Littleton does not use license plate reader cameras and does not receive information from license plate reader cameras.

 

The Town would like to install a license plate reader camera at the intersection of W Bowles Avenue and S Watson Lane. This location is within the City of Littleton public right-of-way. However, S Watson Lane provides access to several properties located within the Town of Columbine Valley, which makes the proposed license plate camera reader location desirable to the Town. The installation of the camera at this location does not violate any standard, rule, or code of the city.

 

A revocable license agreement between the Town and the City is required to authorize the installation of a license plate reader camera at the intersection of W. Bowles Avenue and S, Watson Lane. The revocable license agreement provides the mechanism for the installation of the camera, as well as the mechanism to have the camera removed if desired by the city.  Revocable license agreements are typically addressed administratively by staff, however since this agreement is between two governmental agencies, the license agreement must be approved by Council.

 

BACKGROUND:

The City of Littleton owns and manages public right-of-way throughout the city. Many public and private entities desire to locate benches, walls, outdoor displays, or other items within Littleton’s right-of-way. Utility companies also place their water, sanitary sewer, storm sewer, gas, electric, and other infrastructure lines below ground within the right-of-way. The city allows the various items within the right-of-way to support the uses needed by and activities of the community. Many installations or placements of non-city property within the city’s right-of-way require authorization through a revocable license agreement prior to being installed. The revocable license agreement allows the city to terminate the license under the conditions specified in the agreement; it does not grant any real property interest or other rights beyond the use of the property.

 

The City Charter states any license granted by the city must be revocable at-will by the city.

 

 

The Town of Columbine Valley and City of Littleton have a shared municipal limit boundary from W. Bowles Avenue to just beyond W. Coal Mine Avenue. The Town would like to install a license plate reader camera at the intersection of W. Bowles Avenue and S. Watson Lane. This location is within the City of Littleton public right-of-way. However, S. Watson Lane provides access to several properties located within the Town of Columbine Valley, which makes the location desirable to the Town for a license plate camera reader.

 

Prior Actions or Discussions

There have been no prior discussions of a revocable license agreement at this location.

 

FISCAL IMPACTS:

Since there are no fees associated with the Revocable License Agreement, there are no fiscal impacts.

 

STAFF RECOMMENDATION:

Staff recommends approval of the Revocable License Agreement.

 

ALTERNATIVES:

If this Revocable License Agreement is not approved, the city will not be able to authorize the Town of Columbine Valley to install the license plate reader camera in the proposed location within city right-of-way.
