PURPOSE:
The applicant is requesting approval of an amendment to the Future Land Use and Character Map for 5.6 acres at 16 W. Dry Creek, including Parcels 2077-27-3-00-005 and 2077-27-3-14-021. The proposed Future Land Use and Character Map change is from Suburban Commercial to Suburban Residential Multi-Family. Pursuant to Table 10-9-3.9.1 of the Unified Land Use Code (the “ULUC”), there is a requirement to hold a public hearing at City Council, along with sending notifications to residents within 700 feet and posting two (2) notification signs on the site, ten (10) days prior to the meeting. The proposed amendment to the Future Land Use and Character Map shall meet the following review criteria, pursuant to Section 10-9-4.5.C, as listed below:
1. Compatibility. The land use types and characteristics of the proposed land use category will be compatible with the properties in the immediate vicinity of the subject property.
2. Impact Mitigation. The amendment shall serve to mitigate adverse impacts of the use and development of land on the natural or built environments, including, but not limited to, mobility, air quality, water quality, noise levels, stormwater management, vegetation, or will be neutral with respect to these issues.
3. Comprehensive Plan. The proposed amendment of the Future Land Use and Character Map shall support the goals of the Comprehensive Plan and is aligned with its guiding principles (Authentic, Connected, Active, and Engaged).
4. Changing Conditions. The application for the amendment to the Future Land Use and Character (FLUC) Map shall address the changing conditions of the site, not anticipated at the time of the 2019 Comprehensive Plan and FLUC Map adoption.

DISCUSSION:
The underlying zoning district for this parcel is Corridor-Mixed (CM) which allows for residential uses, however the Future Land Use and Character Map which was updated prior to the City’s comprehensive rezoning process, shows this parcel as suburban-commercial which does not contain residential uses. Pursuant to the City’s Code, while the use may be allowed in the CM zoning district it also needs to be consistent with the character map. As such Council is being asked to amend the Future Land Use and Character Map.
The proposed Future Land Use and Character Map amendment for a 5.6-acre site, located at 16 W. Dry Creek Circle, from Suburban Commercial to Suburban Residential Multi-Family will create a location that may be developed with the underlying Corridor-Mixed (CM) zoning. The proposed land use amendment is supported by the City of Littleton’s goal of focusing on housing diversity, and compliance with the approval criteria.
BACKGROUND:
The original 1988 Planned Development regulations envisioned at 16 W. Dry Creek Circle, envisioned the continued growth in the healthcare offices at the adjacent Highline Professional Center, to its south. The Covid-19 pandemic altered the need for office space and the current owner has been unsuccessful at marketing the property for office or commercial use. There has been developer interest in multi-family residential development. This housing redevelopment potential is consistent with the goal of City Council to provide a mix of housing options in the community.

The applicant has completed the following steps in the entitlement process per the Unified Land Use Code (ULUC):

FISCAL IMPACTS:
The Future Land Use and Character Map change would provide a positive financial impact on the City of Littleton. Please see the staff report for the analysis on the marketability of the site for multi-family residential development, compared with the current land use of office that is experiencing low demand.
STAFF RECOMMENDATION:
The proposed amendment to the Future Land Use and Character Map complies with the approval criteria in Littleton City Code section 10-9-4.5, subsection D, as detailed in the staff report; therefore, staff recommends approval of Resolution 115-2024.
ALTERNATIVES:
Council may approve, approve with conditions, or deny the proposed 5.6-acre Amendment to the Future Land Use and Character Map from Suburban Commercial to Suburban Residential Multi-Family.
