PURPOSE:
Does Council support approving an amendment to an IGA with Mile High Flood District (MHFD) for design and construction of drainage and flood control improvements at Reynolds Landing Park along the South Platte River?

SUMMARY:
The city entered into an Intergovernmental Agreement (IGA) 14-01.24 in May 2014 with MHFD to fund design and construction of improvements at Reynolds Landing on the South Platte River. This is the fourth amendment to the original IGA and would allow incorporation of grant funds the city obtained from Arapahoe County Open Spaces for the Superchi parcel, as well as a 2020 MHFD capital improvement program allocation, into the overall project account. The design contract for Reynolds Landing Park is administered by MHFD through its South Platte River capital improvement program. This amendment to IGA 14-01.24 allows for the 2020 funds mentioned above to be encumbered into the project account for consultant services. MHFD will invoice the city for this amount upon IGA approval.
PRIOR ACTIONS OR DISCUSSIONS:
City Council approved the grant application for Superchi property planning, through Arapahoe County Open Spaces, on May 5, 2020 (Resolution 39-2020). After the grant was awarded, Council approved the intergovernmental agreement with Arapahoe County for planning of the Superchi parcel on August 18, 2020 (Resolution 55-2020).
ANALYSIS:
Staff Analysis
The city, with partners at Arapahoe County and South Suburban Parks and Recreation District (SSPRD), has invested in Reynolds Landing with prior design and construction of Phase 1 and continued design of Phase 2 improvements. This park is highly valued along the river corridor and identified in master planning documents. The next phase of the project includes planning for the recently vacated Superchi parcel, safety and habitat improvements within the river itself, and additional master planning of the park as a whole. MHFD has been a critical partner in administering the design and construction contracts for all projects along the river in the city, as part of the South Platte capital improvement program. Grant funds and MHFD funds are essential in funding the design and construction of this project. This grant is one of several expected grants to help fund this important project. Staff is working with MHFD, Arapahoe County, the South Platte Working Group, and SSPR to collaboratively raise funds.
Council Goal, Objective, and/or Guiding Principle
This project meets Goal 2-Financial Sustainability, Objectives 3 and 4 by identifying this long-term capital need and seeking and leveraging funding from partners and grants, and Goal 3-Good Governance, Objective 3 by continuing our strategic partnership with MHFD.
Fiscal Impacts
This project utilizes grant funds the city received from the County, and the cost match from the Open Space fund. This was appropriated in the 2020 budget.

Alternatives
Should council not approve this amendment, then the city could manage the design and Arapahoe County grant funds separately from the rest of the Reynolds Landing planning effort and budget. However, this could complicate MHFD’s funding contributions to the Superchi portion, and it is considered best for the Superchi property to be planned together with other portions of Reynolds Landing for cohesiveness with the same design consultant team. Having these funds managed by MHFD is a more streamlined approach.
STAFF RECOMMENDATION:
Staff recommends council approve the amendment to the agreement regarding design and construction of drainage and flood control improvements for the South Platte River at Reynolds Landing, IGA 14-01.24D.
