PURPOSE:
Review of proposed revisions to Title 10, the Unified Land Use Code (ULUC) related to the city’s platting and mailing processes for streamlining purposes.

DISCUSSION:
Upon adoption on October 18, 2021, the Unified Land Use Code (ULUC) was intended to be a living document that would need to be updated occasionally in order to better meet the goals of the city. Staff has identified two processes in need of amending to better streamline the process of mailing notifications and platting for certain applications.
BACKGROUND:
The ULUC became effective on October 28, 2021. Since then, staff has meticulously tracked errors, inconsistencies, and ambiguities discovered during implementation. In this most recent effort to modify the Code, staff has identified processes where process redundancies and internal processes may create a backlog to projects, resulting in additional staff time, without creating a better product or furthering city goals.
Proposed Code Amendment
As a result of the community survey, stakeholder group meeting, background research, study sessions, and public review comment period, Staff is proposing the following changes (this list is not all-inclusive):
- Streamline the platting process
- Remove condo plat applications from the ULUC and allow for these application types to be reviewed by the county
- Amend the preliminary plat criteria to reduce regulatory burden for those applications where public right-of-way dedication is required by a city-adopted document
- Clarify Code language
- Remove Code contradictions regarding notice of mailing requirements
Clarifying Notes on the Proposed Changes
While the proposed changes aim to streamline certain processes within the city, this does not remove staff review or alter requirements for any project. For example, while staff is proposing to no longer review condo plats, which is simply the division of a building, staff does still review for the construction or conversion of any property, either through a formal planning review, such as Site Plan, or through the permitting process, where a proposal will be reviewed for compliance of zoning regulations. Similarly, though staff seeks to reduce to regulatory burden for projects where public right-of-way dedication is required, this does not alter the other criteria for preliminary plats, and for example, all subdivision proposals that contain more than four lots, will still be reviewed by the planning commission.
Prior Actions or Discussions
On March 11, 2025, staff met with council and planning commission at a joint study session, to provide an overview of the legislative and nonlegislative updates and to seek feedback on the proposed.
This ordinance passed on first reading on August 19, 2025.

RECOMMENDATION:
The planning commission recommended approval of Ordinance 07-2025 to city council of a code text amendment to Title 10, the Unified Land Use Code regarding the proposed changes to platting and notice of mailing, unanimously (7-0).
ALTERNATIVES:
Council may choose to approve, approve with revisions, or deny the code amendment.
