REQUESTED COUNCIL ACTION:

Does city council support the authorization of the city manager to execute bills of sale for the personal property in Littleton Fire Rescue Stations 11, 12, 13, 14, 15, 16, 17, 18 and 19 on behalf of the City of Littleton, the Littleton Fire Protection District and the Highlands Ranch Metropolitan District?

 

BACKGROUND: 

The city entered into a Pre-Unification Agreement with the South Metro Fire Rescue Fire Protection District (South Metro) on April 18, 2018.  As part of that agreement, all of the real and personal property used by Littleton Fire Rescue and owned by its members will be conveyed to South Metro. 

 

The other members of Littleton Fire Rescue, consisting of the Littleton Fire Protection District and the Highlands Ranch Metropolitan District, desire that the city on behalf of Littleton Fire Rescue convey all of the personal property in the nine stations currently operated by Littleton Fire Rescue to South Metro.

 

PRIOR ACTIONS OR DISCUSSIONS:

The Pre-Unification Agreement with South Metro Fire Rescue Fire Protection District was approved April 18, 2018.  The Asset Conveyance Authorization Agreement is on December 4, 2018 agenda by city council under general business.

 

STAFF ANALYSIS: 

This is one of several transactions before the council as part of the closing on the agreement with South Metro.  All of the transactions before council can be grouped into three broad categories:

 

1.                      Transfer of real property and buildings

2.                      Transfer of personal property

3.                      Leases, licenses and assignments

 

The proposed bills of sale will authorize the city manager on behalf of Littleton Fire Rescue to execute bills of sale that will transfer title to the personal property located in Littleton Fire Rescue Stations 11, 12, 13, 14, 15, 16, 17, 18,  and 19.  Each station has a separate bill of sale providing for the transfer of the property to South Metro.

 

 

OPTIONS/ALTERNATIVES:

The agreements the city has entered into provide for the transfer of this property.  The use of bills of sale such as these is the legally proper way to provide for the transfer of the property.

STAFF RECOMMENDATION:

Staff recommends authorizing the city manager to execute the bills of sale for the personal property in Littleton Fire Rescue Stations 11, 12, 13, 14, 15, 16, 17, 18 and 19.
