POLICY QUESTION:
Does city council support accepting the property ownership transfer from South Suburban Parks and Recreation (SSPR) for Station 19 located on TrailMark Parkway and authorizing the mayor to sign three applications as the property owner?
BACKGROUND:
On December 15, 2015, the city council authorized the construction contract for Station 19 located on TrailMark Parkway. The construction of Station 19 requires three development applications: an Administrative Amendment to the Planned Development (APD15-0003), the Subdivision Exemption (SDE15-0003), and the Site Development Plan (SDP15-0022). The three applications are administrative and do not require council review or approval of the land use; however, by approving this resolution, council accepts the ownership of a portion of Tract D, via quit claim deed, and authorizes the mayor to sign the applications on behalf of the city, as the property owner of Tract C and the quit claimed portion of Tract D.
The quit claim will occur in two parts. The first is for about 900 square feet, which has already been approved by SSPR. The second quit claim, which is not necessary for the construction of the building, but will be pursued with SSPR to capture the final paved surface of the station access.
This request is for authorization for the mayor to execute the applications and recorded documents, on behalf of the city as the property owner. This is not a request for land use approval by the council. The three development applications are:
1. The administrative amendment to the existing planned development is required to reduce the rear setback.
2. The subdivision exemption is required to revise the size of Tract C to accommodate the station building.
3. A site development plan is required for the construction of the building.
The property owner needs to sign the mylars for the above applications prior to being recorded.
STAFF ANALYSIS:
Approval of these applications is necessary for the construction of Station 19 because the city is the applicant.
FISCAL IMPACTS:
SSPR will transfer ownership via quit claim deeds at no cost to the city.
STAFF RECOMMENDATION:
Staff recommends approval of the resolution.
