PURPOSE:

The police and finance departments seek to amend the current contract(s) with Axon Enterprise, Inc. by combining all existing Axon contracts and extending the amended contract to March 31, 2030.

DISCUSSION:

The Police Department currently contracts with Axon for several products and services including body-worn cameras (BWC), Tasers, digital evidence management/storage, and interview room recording.  Due to varying timeframes of when these products/services came online with the LPD, there are different contracts for several of them.  The current primary contract covers most BWC, digital evidence storage, and Tasers and is due to expire April 30, 2027.  There is also a separate contract for additional BWC hardware and licensing related to the police personnel expansion in 2024.

 

The Police Department and Finance Department seek to combine all existing Axon contracts into a single amended contract with an expiration date of March 31, 2030.  Axon product and service costs have significantly increased during the current contract and are anticipated to continue to rise substantially in coming years.  By amending the Axon contract the City of Littleton will secure 2024 pricing for the length of the contract and stands to have significant savings in the long term by avoiding annual price increases (currently 10-12% per year).  In addition to the long-term savings, the combination of multiple contracts into one provides ease of accounting and fiscal management by all involved departments.  

 

Additionally, the amended contract provides an opportunity for the LPD to include a report writing module designed to increase accuracy and improve efficiency and complete a recommended upgrade of its Taser inventory under 2024 pricing structure.

 

BACKGROUND:

The LPD has utilized Tasers for many years however, in 2020 the Colorado State Legislature enacted Senate Bill 20-217 which mandated all Colorado Law Enforcement agencies equip all sworn personnel with BWC by July 1, 2023.  The LPD contracted with Axon to provide sworn personnel with BWC beginning May 2022.  The existing contract with Axon covers the majority of BWC hardware inventory, interview room camera/audio recording, related video data storage/management, and Tasers.  There are currently additional contracts with Axon related to BWC hardware and licensing and Tasers for expansion personnel hired in 2024. 

 

Prior Actions or Discussions

Council approved the current Axon contract in March 2022 (Res. 15-2022).  That resolution provided for similar combination of the existing Taser contract with the new BWC contract.

 

FISCAL IMPACTS:

The total 5-year amended contract cost is $2,127,722.92with annual payments beginning April 2025 as noted below:

                     April 2025 - $276,914.00 (current contract price for 2025 - included in the 2025 budgeted)

                     May 2025 - $10,728.00 (current contract - included in the 2025 budget)

                     April 2026 - $460,020.23

                     April 2027 - $460,020.23

                     April 2028 - $460,020.23

                     April 2029 - $460,020.23

 

This contract is more than the previous agreement as we have added new services as well as a vendor increase in contract amount. Without this contract, our costs would increase approx. 10-12% annually. This contract allows us to maintain the same annual payment year over year through 2029. It is in the best interest of the city to realize a cost savings by entering into this agreement.

 

This contract is greater than $500,000, and therefore requires council approval.  Also, these services were procured using as a sole source. Axon is the only vendor that meets local law enforcement specifications and allows for interoperability with surrounding jurisdictions and meets electronic discovery requirements in area Judicial Districts.

 

STAFF RECOMMENDATION:

Staff recommends approving the resolution to amend the contract with Axon Enterprise, Inc.

 

ALTERNATIVES:

Maintain current contract until expiration and then pay new rates effective as of May 2027.  Anticipated increase in cost is 10-12% per year.
